President Luiz Inácio Lula da Silva (PT) edited a decree that revokes a series of rules by the Jair Bolsonaro (PL) government that facilitated and expanded the population’s access to firearms and ammunition. In general terms, the decree suspends new gun registrations by hunters, shooters and collectors (CACs) and by private individuals; reduces the limits for purchasing weapons and ammunition for permitted use; suspends new registrations of clubs and shooting schools; suspends granting new registrations to CACs and; creates a working group to propose new regulations for the 2003 Disarmament Statute. The decree also provides that all weapons purchased since May 2019 must be re-registered by owners within 60 days. At the same time, until the new regulation is published, the decree extends the validity of expired registrations.
Minor Arsenal for CACs
Lula’s decree also revokes the expansion of the allowed weapon limit established in June 2019. Under the previous rule, the limits were 5 weapons for collectors, 15 for hunters and 30 for shooters. The new limit is three weapons per person, regardless of category. The text also defines that the interested party must present “proof of effective need” to buy a gun – in line with the recent decision of the Federal Supreme Court on the subject.
